Terms and Conditions for our Services

The following terms and conditions are valid for the services which ColibriVentura offers to its clients, our services include (outdoor) activities on expeditions, tours, trips, travels and projects, logistics services, administrative services, services in the area of mine and land surveying and geodesy, and other services. ColibriVentura works with providers - some of them called Service Partners, which are not part of ColibriVentura and who have their own terms and conditions which apply whenever the client uses the services of the providers. ColibriVentura is only responsable under those below stated terms and conditions for our mediation of the services with those providers and Service Partners and other service suppliers, like rent-a-car agencies, hotels, hostals, and the like, but not for the services the providers/suppliers/Service Partners offer.

a) Responsibilities

The client using one or more services of ColibriVentura is responsible for understanding the conditions implied in the service(s) offered, a client is responsible for selecting services appropriate to her/his interests and abilities. For some of the services offered (e.g. (outdoor) activities) a client needs to bring the necessary and appropriate equipment, as stated in the equipment list.

Every client needs to follow passport, custom, visa, health and other applicable regulations of the country or countries in which the service is to be delivered to the client, if the service requires the physical attendance of the client in that country /those countries. All disadvantages resulting from non-fulfillment of these regulations are the sole responsibility of the client.

If, for a pre-scheduled service like a tour or an expedition, the client does not comply with the previously agreed schedules, or is not willing to follow an adjusted schedule due to circumstances that ColibriVentura has no influences upon (like adverse weather, big objective risks and dangers), ColibriVentura can not be held responsible for any disadvantages which might arise to the client.

The client is responsible for following rules, regulations, and appropriate customs if she/he is in the country or countries where the services are offered to her/him. Special regulations might apply in Nature reserves, National Parks of that country/those countries, which the client is responsible to follow. If the client fails to do so, she/he is responsible for all consequences.

ColibriVentura shall not be held liable for (A) any damage to, or loss of, property, or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider, and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent, thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond ColibriVentura's control. The client waives any claim against ColibriVentura for any such loss, damage, injury, or death.

ColibriVentura has only limited influence on services purchased from other providers. Last minute changes in flight plans must be expected regularly. They are the responsibility of the airlines and the national flight coordination authorities.

ColibriVentura's staff is not responsible for pointing out permanent dangers and risks which could occur during an outdoor activity or other services, if those must obviously be known to the client.

b) Bases of Prices

All prices and fares are quoted in Chilean Pesos and EURO. The rates are based on current tarifs and money exchange rates and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge we reserve the right to do so and notification will be given at the time of final invoicing.

c) Included and Excluded in Prices

Please refer to the information provided with the service description to find out what is included in the price you pay and what is excluded. Not included, except if indicated in the information materials provided for that service, are excess baggage charges; services noted as optional in the service description; passport and visa expenses; transfers from arrival airport or port to meeting point and from the hotel/meeting point to departure airport or other points; air transportation and related fees; baggage/ accident/health/expedition/cancellation insurance; personal expenses such as communication charges, alcoholic beverages, laundry, repairs; and any other items not specifically noted as included.

d) Reservations, Bookings, Cancellations and Refunds

If you want to book, contact us. If our website does not provide prices for some specific services, ask us for a quotation, specifying the service and as much as possible the details you want to have included. After we come to an agreement, we will send you the final quotation and our bank details.

A pre-payment of 50% of the total cost of all services booked from us is required at the time you book. With this payment you constitute your acceptance to ColibriVentura's Terms & Conditions and the booked service(s) is/are reserved for you as soon as the money shows up at our bank account.

The remainder of the price of the service(s) booked needs to be cancelled at our bank account prior to the starting time of the (first) service, or cancelled latest in cash in Chilean Pesos prior to the start of the (first) service with a ColibriVentura representative.

The full payment is required, if you book service(s) within 30 days of the starting date of the (first) service(s).

If for any reason you cancel more than 60 days prior to the start of the service, a refund of your pre-payment less a 50.000 Chilean Pesos or 75 EURO administration fee per reservation will be made. Bank transfer rates for the refunded amount have to be paid by the client in this case. The client needs to provide accurate bank detaills to ColibriVentura for a timely refund.

Charges for cancellations that occur less than 61 days prior to the starting time of the service(s) are as follows:


  • 60 - 41 days prior to departure: 25% of the total cost of the cancelled service(s);

  • 40 - 31 days prior to departure: 50% of the total cost of the cancelled service(s);

  • 30 - 0 days prior to departure: 100% of the total cost of the cancelled service(s).


This policy also applies to pre- and post-service extensions.

Changes of the booked starting date(s) of our provided service(s) are only possible by canceling the reserved service(s) and a rebooking afterwards. If these changes are made more than 60 days prior to the starting date of the (first ) service(s), a 10.000 Chilean Pesos or 15 EURO fine per client will be charged.

If the client does not show up at the beginning of a service, misses a connection or is held incapable to continue her/his participation in the service because of incomplete travel documents, this counts as a cancellation of the service.

ColibriVentura reserves the right to cancel any service which is offered for more than one client at a time if that service becomes economically unfeasable to operate. ColibriVentura also reserves the right to cancel any service because of good-faith concerns with respect to the safety, health, or welfare of the client(s). If ColibriVentura cancels a service prior to its starting time, the client will receive a full refund of monies paid to ColibriVentura. If ColibriVentura cancels the service when it is in progress, the client will receive a refund based on the percentage of the service not yet provided to the client. ColibriVentura will not be responsible for any refund for nonrefundable airline tickets, or for any airline tickets purchased by the client directly from an airline or travel agent.

If the client leaves a service provided by ColibriVentura whilst this service is not yet fully finished, for any reason whatsoever, the client will not get a refund, and no refunds will be made for any unused portions of a service, such as hotel nights, meals, city tours etc.

Trip cancellation insurance is strongly recommended and advised.

e) Itinerary Changes

The presented itineraries are subject to modification and change by ColibriVentura without penalty. Every reasonable effort will be made to provide services as planned, but alterations may still occur after final itineraries are sent. ColibriVentura's staff reserve the right to provide clients with an alternative service/activity if conditions are not appropriate.

ColibriVentura also reserves the right to change the order of the objectives in any itinerary under the sole discretion of ColibriVentura's staff and based on operational considerations. ColibriVentura's staff can also modify, change or eliminate part of the itinerary based on safety/weather considerations.

ColibriVentura reserves the right to make any client responsible for unnecessary expenses or losses due to delays or irresponsible actions caused by a client.

Providers, Service Partner, Travel agencies and intermediates are not authorized to change or accept and/or propose alterations of ColibriVentura's services and Terms & Conditions without ColibriVentura's permission.

f). Health Requirements

The client must be in a good physical and mental health. Any physical and/or mental condition requiring special attention, diet, or treatment must be reported prior to the booking of the service(s). ColibriVentura reserves the right to decline to accept any person as a client and participant of any of our services. ColibriVentura's staff has the right to disqualify anyone at any time during the service/activity, if the staff members feel the participant is physically or mentally incapable and/or if a client's continued participation will be detrimental to the health, safety, and general welfare of the individual involved or other clients . Refunds are not given under such circumstances. Any possible additional expenses for return transfers are the sole responsibility of the client.

Because of the fact that hospital facilities for serious problems are often unavailable and evacuation can be prolonged, difficult and expensive, it is that ColibriVentura assumes no liability regarding provision of medical care at any time during the trip.

All passengers over 50 years old who participate in any of more strenous activities like hiking, kayaking, horseriding, mountaineering, iceclimbing, caving or trekking and/or activities or services which include any other physical activity are requested to send ahead a doctor's certificate that states that they are able to safely accomplish the activities they are interested in valid only with the signature and stamp of a physician.

ColibriVentura presumes that the client knows how to swim. Non-swimmers may only participate in any services offered that do not includes any water activity. If ColibriVentura's staff is in doubt about the swimming capabilities of the client, it reserves the right to test the client's swimming capabilities.

g) Insurance

The client must accept full responsibility for insurance up to limits which the client may deem necessary for the specific activities that the client presumes to take part in. This insurance must cover personal accident, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses which may arise as a result of loss, damage, injury, delay or inconvenience occurring to the client. ColibriVentura highly recommends that all clients who use services which require travelling have personal travel insurance. When obtaining travel insurance, the client must ensure the insurer of the type of travel/activity to be undertaken, specially when "adventure activities" are included in the service and that it covers the country/ countries specified in the service information provided by ColibriVentura.

Because of the insurance the client is not left free from her/his obligation to pay cancellation fees to ColibriVentura; she/he only has devolution rights against the insurance as mentioned in the conditions of the insurance.

h) Luggage

For safety and because of space limits in vehicles, refugios etc. ColibriVentura recommends to carry only the necessary equipment with you. Ecxess luggage can be left until the end of the service at ColibriVentura's Base or a hotel/hostal/refugio if this does not interfere with the itinerary of the services provided to clients. The client is responsible for carrying and taking care of her/his luggage at the airport, to/from the vehicles, inside the hotels, etc.

Luggage and personal effects are at owner's risk throughout the services.

i)Provided Equipment

ColibriVentura provides equipment as specified in the information materials describing every service. If equipment of ColibriVentura gets lost or damaged because of the clients improper use, treatment and caring of that equipment, the client will be responsible for the replacement costs of the equipment.

j)Photography and Video

ColibriVentura reserves the right to take pictures and/or videos during the operation of any service or part thereof, and to use the resulting pictures and/or video materials for promotional purposes on our Website, flyers, books and other media, leaving the copyrights of this material to ColibriVentura. By booking a service with ColibriVentura, the client agrees to allow her/his images and/or voice to be used in such media. Clients who prefer that their image and/or voice will not be used are asked to identify themselves to ColibriVentura's staff prior to the starting date of a service provided by ColibriVentura.

k) Group Activities and Guiding in Argentina

In many group activities it is necessary that the participants help. Preparing meals, setting up tents on their own, taking care of and helping with packing the equipment are just some of the activities which will occur and handled as a group activity during a trekking/kayaking/mountaineering/horseriding/ etc tour or expedition. It can also be necessary at night and during difficult weather conditions that clients must participate actively in helping out and finding solutions for any possible problems.

ColibriVentura's staff are partly not allowed to guide in Argentina. Within the restrictions of the Argentine law ColibriVentura is only allowed to bring a tour coordinator. The tour coordinator has limited possibilities and rights. The guidance etc. is reserved to local and licensed guides. ColibriVentura has to use those local guides a under some circumstances and so it is possible that the guidance than is in Castellano (Spanish).

l) Applicable law

You agree that these terms of use and any dispute arising out of the your use of ColibriVentura's services or products shall be governed by and construed in accordance with local laws in force at the headquarters of ColibriVentura in Coyhaique, XI Region de Aisén del General Carlos Ibañez del Campo, Chile, without regard to its conflict of law provisions. By booking or using ColibriVenturas service(s) and or products, you consent and submit to the exclusive jurisdiction and venue of the location of the headquarters of ColibriVentura.

k) Miscellaneous information

(i) In the event that these terms of use conflict with any law under which any provision may be held invalid by a court with jurisdiction over the parties, such provision will be interpreted to reflect the original intentions of the parties in accordance with applicable law, and the remainder of these terms & conditions will remain valid and intact; (ii) The failure of either party to assert any right under these terms & conditions shall not be considered a waiver of that party's right, and that right will remain in full force and effect; (iii) You agree that, without regard to any statute or contrary law, that any claim or cause arising out of the use of services and or products from ColibriVentura must be filed within one (1) year after such claim or cause arose, or else the claim shall be forever barred.
